Acceptance of Terms

By accessing or using the AiFlowlytics website located at https://aiflowlytics.com (the "Site") and any related services, pages, courses, memberships, or products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you are prohibited from using or accessing the Services.

These Terms apply to all visitors, users, members, and others who access or use the Services. By using the Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

AiFlowlytics provides educational content, online courses, training materials, and membership programs focused on AI-powered business strategies, automation, and growth methodologies. Our Services include, but are not limited to:

Community access and support

Email newsletters and communications

SMS notifications and updates

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

4Membership Plans & Pricing

AiFlowlytics offers the following membership and course options:

4.1 AiFlowlytics Lifetime Membership and Master Course

This is a one-time payment option that grants you lifetime access to the AiFlowlytics Master Course and all included membership benefits. The lifetime membership includes access to all current and future course updates for as long as the program exists.

4.2 AiFlowlytics Monthly Membership and Master Course

This is a recurring monthly subscription that grants you access to the AiFlowlytics Master Course and membership benefits. Your subscription will automatically renew each month until cancelled. You are responsible for all recurring charges until you cancel your subscription.

All prices are displayed in US Dollars (USD) unless otherwise specified. Prices are subject to change, but any price changes will not affect existing active subscriptions or completed lifetime purchases.

5Payment Terms

By purchasing any of our Services, you agree to the following payment terms:

All payments must be made through our authorized payment processors

You authorize us to charge your payment method for the agreed-upon amount

For monthly subscriptions, you authorize recurring charges on each billing cycle

You are responsible for providing accurate and current payment information

All fees are exclusive of applicable taxes, which may be added to your total

5.1 Monthly Subscription Billing

For the AiFlowlytics Monthly Membership and Master Course, your payment method will be charged automatically on the same date each month as your original purchase date. If that date does not exist in a given month (e.g., the 31st), you will be charged on the last day of that month.

5.2 Payment Method Updates

It is your responsibility to keep your payment information up to date. If your payment method expires or is declined, you must update your payment information promptly to avoid service interruption.

6No Refund Policy

90-Day Guarantee Terms

90-DAY PERFORMANCE GUARANTEE — TERMS & CONDITIONS

1. Guarantee Statement. The company offers a 90-day performance guarantee ("Guarantee") to eligible Clients who meet all qualifying conditions set forth herein. This Guarantee applies only to the Lifetime Access and DFY Agency Buildout packages purchased at full price. By purchasing, Client acknowledges having read, understood, and agreed to all terms of this Guarantee.

2. Eligibility Requirements. To qualify for the Guarantee, Client must satisfy ALL of the following conditions during the 90 days following purchase:

a) Course Completion. Client must complete 100% of the core training modules, as verified by the learning management system, within the first 60 days of enrollment.

b) Implementation Documentation. The client must provide documented proof of implementing the following core program elements:

Launched podcast or interview-based content (minimum ten published episodes/interviews)

Created and distributed an authority asset (whitepaper, lead magnet, or equivalent)

Completed sales call framework training and conducted a minimum of 5 documented sales conversations

Active outreach campaign (minimum 1000 documented outreach touches a month via email, LinkedIn, or phone)

c) Coaching Participation. Client must attend a minimum of six (6) live coaching calls or submit six (6) questions/updates to the community for feedback during the 90 days.

d) Support Engagement. Client must request and participate in at least one (1) strategy review or support call with the Company team to troubleshoot their approach before requesting a refund.

e) Good Faith Effort. Client must demonstrate consistent, good-faith effort throughout the 90 days. Enrolling, not engaging with the materials, and requesting a refund do not constitute a good-faith effort.

3. Exclusions. This Guarantee does NOT cover the following:

Monthly membership subscriptions (cancel anytime, no refunds for used periods)

Clients who purchased at promotional or discounted rates

Clients who have previously received a refund from the Company for any product

Clients who violate any term of service

Clients who initiate chargebacks or payment disputes

4. Time-Based Value Depreciation (Lifetime Access Only). Client acknowledges that Company incurs high costs upon enrollment, including but not limited to: sub-account provisioning, platform access, course delivery, community access, live call support, and administrative overhead. To account for the value received during the Guarantee period, any eligible refund for Lifetime Access purchases shall be subject to the following depreciation schedule:

Refund Request Period, Depreciation Applied, Maximum Refund Percentage: Days 1–30, 25% of 75% of purchase price.  Days 31–60: 50% of 50% of the purchase price. Days 61–90: 75% of 25% of the purchase price

The depreciation percentage is calculated based on the date the refund request is submitted (not the approval date). Depreciation is applied to the base purchase price before any additional deductions are calculated.

5. Refund Request Procedure. To request a Guarantee refund, the Client must:

a) Submit a written refund request via email to [email protected] between Day 85 and Day 90 of their enrollment period. Early requests will not be processed.

b) Include in the request:

Proof of course completion (screenshots or system verification)

Links to published podcast episodes/interviews

Copy of the distributed authority asset

Documentation of outreach efforts (screenshots, spreadsheets, or CRM exports showing a minimum of 100 touches)

Log of sales conversations conducted (dates, prospect names/companies, outcomes)

Attendance records or community engagement screenshots

c) Complete an exit interview call with the Company to review implementation and discuss what was attempted.

6. Review & Determination. The company will review all submitted documentation within fourteen (14) business days of receiving a complete refund request. The company reserves the sole discretion to determine whether eligibility requirements have been satisfied. Incomplete documentation or failure to meet any single requirement disqualifies Client from the Guarantee.

Any enrollment completed with a discount code is excluded from all guarantees.

7. Refund Calculation.

a) Lifetime Access Refund Calculation:

Apply the Time-Based Value Depreciation percentage based on the date of the refund request submission.

From the depreciated amount, subtract: Any affiliate commissions paid on the original purchase, Fair market value of AI credits consumed, Any third-party service costs billed to Company on Client's behalf, Payment processing fees (approximately 3–5%)

The final refund amount shall be the greater of $0 or the result of the above calculations.

Example (Lifetime Access at $1,995):

Refund requested Day 25: $1,995 × 75% = $1,496.25, minus deductions

Refund requested Day 45: $1,995 × 50% = $997.50, minus deductions

Refund requested Day 88: $1,995 × 25% = $498.75, minus deductions

b) DFY Agency Buildout Refund Calculation: Client acknowledges that DFY Agency Buildout purchases involve substantial upfront labor, strategy, and deliverable creation that cannot be recouped. Therefore, any eligible refund for the DFY Agency Buildout shall be calculated as:

Purchase price minus a flat deduction of Three Thousand Five Hundred Dollars ($3,500.00) for strategy, setup, and deliverables commenced or completed

From the remaining amount (if any), subtract: Any affiliate commissions paid on the original purchase, Fair market value of AI credits consumed, Any third-party service costs billed to Company on Client's behalf, Payment processing fees (approximately 3–5%)

The final refund amount shall be the greater of $0 or the result of the above calculations.

Example (DFY Buildout at $9,995):

$9,995 minus $3,500 flat deduction = $6,495, minus additional deductions

If additional deductions total $200, final refund = $6,295

If additional deductions exceed the remaining balance, final refund = $0

8. Non-Transferable. This Guarantee is personal to the original purchaser and may not be transferred, assigned, or claimed by any other party.

9. One-Time Use. The Guarantee may only be claimed once per person, regardless of the number of purchases made or accounts created.

10. Chargebacks & Payment Disputes. Client agrees not to initiate chargebacks, payment disputes, or reversals for purchases covered under this Guarantee. Initiating a chargeback or dispute immediately disqualifies the Client from this Guarantee and any refund. In the event of a chargeback or dispute, Client agrees to pay all costs incurred by Company in responding to such dispute, plus a Five Hundred Dollar ($500.00) administrative fee. The company reserves the right to suspend or revoke access to all delivered work and platform access until the matter is resolved.

11. Acknowledgment. By purchasing, Client acknowledges understanding of the depreciation schedule (for Lifetime Access) and the flat deduction (for DFY Buildout), and agrees that these represent a fair allocation of the value received during the Guarantee period. Client further acknowledges that these terms incentivize prompt engagement with program materials and timely communication of any concerns.

12. Dispute Resolution. Any disputes regarding Guarantee eligibility shall be resolved through binding arbitration in accordance with the Dispute Resolution section of these Terms of Service. Client agrees that Company's documented assessment of eligibility requirements shall be given substantial weight in any arbitration proceeding.

Due to the digital nature of our products and the immediate access granted upon purchase, all sales are final and non-refundable. Please read this section carefully before making any purchase.

6.1 AiFlowlytics Lifetime Membership and Master Course

The AiFlowlytics Lifetime Membership and Master Course is a digital product that provides immediate access to our course materials and membership benefits. No refunds will be issued for the Lifetime Membership under any circumstances. By completing your purchase, you acknowledge that you have read and understand this no-refund policy and agree to waive any right to a refund.

6.2 AiFlowlytics Monthly Membership and Master Course

The AiFlowlytics Monthly Membership and Master Course provides immediate access to our course materials and membership benefits upon each payment. No refunds will be issued for any monthly payments, including the initial payment or any subsequent recurring payments. You may cancel your subscription at any time to prevent future charges, but you will not receive a refund for any payments already processed.

6.3 Cancellation vs. Refund

Cancelling your monthly subscription is not the same as requesting a refund. When you cancel:

You will retain access until the end of your current billing period

No future charges will be processed

No refund will be issued for the current or any previous billing periods

6.4 Acknowledgment

By purchasing any of our products or services, you expressly acknowledge and agree that:

You have read and understand this no-refund policy

You waive any right to a refund, chargeback, or payment dispute

You are making an informed decision to purchase

Digital products cannot be "returned" once accessed

7Failed Payments & Access Denial

⚠️ PAYMENT FAILURE CONSEQUENCES

Your access to Services is contingent upon successful payment. Failed payments will result in immediate suspension of access.

7.1 Monthly Subscription Payment Failures

For AiFlowlytics Monthly Membership and Master Course subscribers, if your recurring payment fails to process for any reason, including but not limited to:

Insufficient funds

Expired credit/debit card

Declined transaction by your bank or card issuer

Invalid or outdated payment information

Exceeding credit limit

Fraud prevention blocks by your financial institution

7.2 Access Suspension

Upon a failed payment:

Immediate Suspension: Your access to all course materials, membership content, and Services will be suspended immediately upon payment failure

No Grace Period: We are not obligated to provide any grace period for failed payments, though we may do so at our sole discretion

Retry Attempts: We may attempt to process your payment again within 24-72 hours. During this time, your access may remain suspended

Notification: We will attempt to notify you of the failed payment via email and/or SMS

7.3 Reinstatement of Access

To reinstate your access after a payment failure:

Update your payment information in your account settings

Ensure sufficient funds are available

Contact your bank to authorize the transaction if necessary

Successful processing of the payment is required before access is restored

7.4 Repeated Payment Failures

If your payment fails multiple times (three or more consecutive attempts), we reserve the right to:

Cancel your subscription entirely

Require a new sign-up with a valid payment method

Refuse future service at our discretion

7.5 No Liability for Access Interruption

We are not liable for any loss, damage, or inconvenience caused by access suspension due to payment failures. It is your sole responsibility to maintain valid, up-to-date payment information.

2.1 General Disclaimer

While AiFlowlytics™ employs industry-leading AI technology, proven outreach strategies, and best practices to maximize client results, we do not guarantee any specific outcomes, results, or performance metrics, including but not limited to:

Number of booked appointments or calls

Response rates or reply rates

Lead conversion rates

Sales closed or revenue generated

Connection acceptance rates

Message delivery rates

2.2 Results May Vary

Performance outcomes are influenced by numerous factors outside of AiFlowlytics™'s control, including but not limited to:

Quality and relevance of the target audience

Industry, niche, and market conditions

Offer positioning and value proposition

LinkedIn profile optimization and credibility

Timing and seasonal variations

Platform algorithm changes

Client's closing abilities and follow-up processes

Client-provided messaging, offers, and creative assets

3. Done-For-You (DFY) Service - Prodfy

3.1 Best Efforts Commitment

For clients utilizing our Prodfy Done-For-You service, AiFlowlytics™ commits to:

Implementing proven outreach strategies and campaigns

Utilizing hyper-personalized messaging techniques

Conducting ongoing optimization based on performance data

Providing dedicated account management and support

Leveraging AI technology to maximize relevance and engagement

Making our best efforts to generate as many qualified booked calls as possible

3.2 DFY Service Scope

Our DFY service includes active management, campaign optimization, and strategic adjustments. However, we do not guarantee any minimum number of booked calls, appointments, or leads. Our commitment is to apply professional expertise, proven methodologies, and continuous optimization to work toward your desired outcomes.

3.3 Performance Factors

DFY service performance depends on multiple collaborative factors:

Accuracy and quality of the ideal customer profile (ICP) provided by the client

Client's responsiveness to prospect inquiries

Client's sales process and closing capabilities

Quality of the client's LinkedIn profile and social proof

Client's offer attractiveness and market positioning

4. Self-Service Packages (ProspectFlow Essentials & ProspectFlow Agents)

4.1 Self-Service Nature

ProspectPro Essentials and ProspectFlow Agent packages are self-service platforms that provide:

Access to AI-powered automation tools and technology

Platform features and functionality as described

Technical support for platform usage

Educational resources and best practices

4.2 No Performance Guarantees

As self-service solutions, these packages:

Provide tools and technology only - implementation and results depend entirely on client usage.

Offer no guarantees regarding outcomes, performance, or results

Require client responsibility for campaign setup, targeting, messaging, and optimization

Success depends onthe  client's skill, strategy, and execution

4.3 Client Responsibility

Clients utilizing self-service packages are solely responsible for:

Campaign strategy and targeting decisions

Message creation and personalization

Compliance with LinkedIn terms of service

Monitoring and optimizing campaign performance

Following platform best practices and guidelines

Their own results and outcomes

5. Platform Availability & Technical Performance

5.1 Service Uptime

While we strive for maximum platform availability, AiFlowlytics™ does not guarantee:

100% uptime or uninterrupted service

Immunity from third-party platform changes (LinkedIn, API providers)

Protection from force majeure events or circumstances beyond our control

5.2 Third-Party Dependencies

Our services rely on third-party platforms (including but not limited to LinkedIn, API services, and cloud infrastructure). Changes, restrictions, or disruptions to these platforms may impact service delivery and are beyond our direct control.

6. Refund & Cancellation Policy

6.1 Service Delivery

Refunds are not provided based on performance results or outcomes. Our obligation is to provide access to the platform, tools, and services as described, not to guarantee specific results.

6.2 Technical Issues

Refunds may be considered for significant technical failures that prevent platform access or service delivery, as described and evaluated on a case-by-case basis.

7. Client Obligations

To maximize potential for success, clients agree to:

Provide accurate information and targeting criteria

Maintain professionally optimized LinkedIn profiles

Respond promptly to prospect inquiries and booked calls

Follow platform guidelines and best practices

Comply with all applicable laws and regulations

Not engage in spam, harassment, or violations of LinkedIn's terms of service

8. Limitation of Liability

AiFlowlytics™'s liability is limited to the fees paid by the client for the specific service period in question. We are not liable for:

Lost profits, opportunities, or business

Indirect, incidental, or consequential damages

Results or outcomes from the use of our services

Actions or inactions of third-party platforms

Client's implementation or strategic decisions

9. Modifications to Services

AiFlowlytics™ reserves the right to:

Modify features, functionality, or service offerings with reasonable notice

Adjust pricing for future billing periods

Discontinue services that become technically unfeasible or legally problematic

Update terms and policies as needed for legal compliance or business operations

10. Agreement to Terms

By subscribing to any AiFlowlytics™ service (ProspectPro, Prodfy, or ProspectFlow Agents), you acknowledge that:

You have read and understand these terms

You accept that no guarantees are provided regarding results or outcomes

You know the differences between DFY and self-service offerings

You agree to the limitations and responsibilities outlined herein

8Chargeback Policy

🚫 CHARGEBACKS ARE PROHIBITED

Initiating a chargeback or payment dispute is a violation of these Terms and will result in immediate and permanent account termination, as well as additional consequences outlined below.

8.1 Definition of Chargeback

A "chargeback" refers to any dispute, reversal, or cancellation of a payment initiated by your bank, credit card company, payment processor, or another financial institution, rather than through our official cancellation or customer service channels.

8.2 Chargeback Prohibition

By purchasing our Services, you agree NOT to initiate a chargeback for any reason, including but not limited to:

Dissatisfaction with the course content

Failure to use or complete the course

Change of mind after purchase

Claiming you did not authorize the purchase

Forgetting about the subscription or purchase

Any other reason whatsoever

8.3 Consequences of Chargeback Attempts

If you initiate a chargeback or payment dispute, the following actions will be taken:

Immediate Account Termination: Your account and all access to Services will be permanently terminated without notice

Permanent Ban: You will be permanently banned from purchasing or accessing any AiFlowlytics products or services in the future

Collection Actions: We reserve the right to pursue collection of all amounts owed, including the original purchase price plus any fees we incur

Chargeback Fees: You agree to pay any chargeback fees, administrative fees, or penalties assessed to us by payment processors (typically $15-$100 per chargeback)

Legal Action: We reserve the right to pursue legal action to recover all amounts owed, including attorney's fees and court costs

Credit Reporting: Unpaid amounts may be reported to credit bureaus and/or referred to collection agencies

8.4 Disputing in Good Faith

If you have a legitimate billing concern, you agree to contact us directly at [email protected] before contacting your bank or initiating any dispute. We are committed to resolving billing issues in good faith when customers communicate with us directly.

8.5 Fraudulent Chargebacks

Filing a chargeback for a legitimate purchase you made and received access to constitutes fraud. We maintain detailed records of all transactions, IP addresses, login activity, and course access, which we will provide to financial institutions and law enforcement if necessary to dispute fraudulent chargebacks.

9SMS Communications

9.1 Consent to Receive SMS

By providing your phone number and opting in to receive SMS messages from AiFlowlytics, you expressly consent to receive text messages from us. These messages may include:

Each individual is limited to one account. Creating multiple accounts to take advantage of promotional offers or circumvent our policies is prohibited.

12Intellectual Property

All content available through our Services, including but not limited to text, graphics, logos, images, videos, audio, software, and course materials, is the property of AiFlowlytics or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

12.1 Limited License

Upon purchase, you are granted a limited, non-exclusive, non-transferable license to access and view the course content for your personal, non-commercial use only.

12.2 Prohibited Uses

You may NOT:

Copy, reproduce, or duplicate any course content

Distribute, share, or resell course materials

Record, download, or capture video or audio content (unless expressly permitted)

Create derivative works based on our content

13Prohibited Uses

You agree not to use the Services to:

14Termination

You may cancel your monthly subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period.

14.2 Termination by Us

We reserve the right to suspend or terminate your account and access to Services immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms

Payment failures or chargebacks

Fraudulent activity

Account sharing or credential distribution

Abusive behavior toward staff or other members

Violation of intellectual property rights

14.3 Effect of Termination

Upon termination, your right to access the Services will immediately cease. No refunds will be provided for any reason upon termination.

15Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Services will meet your specific requirements

The Services will be uninterrupted, timely, secure, and error-free

The results obtained from the Services will be accurate or reliable

Any errors in the Services will be corrected

No Guarantees of Results: AiFlowlytics provides educational content only. We make no guarantees regarding income, business success, or any specific outcomes from using our courses or materials. Results vary based on individual effort, circumstances, and many factors outside our control.

16Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIFLOWLYTICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

18Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of ARIZONA, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in MARICOPA County, ARIZONA. You consent to the personal jurisdiction of such courts.

19Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.
